Terms of Use for myPersonalDoc & Surgical
Travel :

This is a HIPPA
compliant secure platform used by medical provider (MD, DO, NP or PA).
·
You will be sent
a link to download your medical record and discharge instructions after your
visit.
·
You will need a
phone and computer with a webcam.
·
A WebCam™ is
useful for minor medical conditions or complaints. It should not be used for
concerns like chest pain, shortness of breath, severe abdominal pain,
uncontrollable bleeding, new or severe headache, obvious broken bones, new
weakness or numbness.
·
You will need to
have your credit card information easily accessible.
·
The provider may
recommend that you come into the urgent care to see them in person or that you
go to an emergency department.
·
If you have
entered the site from a specific urgent care, you will be seen by one their
providers unless they are not available and then you will be treated by the
next available provider in your state.
·
Controlled
medication (narcotics, benzodiazepines, tranquilizers, stimulants) will not be
prescribed.
·
If, after
consultation with a provider, you need to be seen in an urgent care or
emergency department, your money will not be refunded since that provider still
had to review your information and provide a WebCam™

READ THE TERMS AND CONDITIONS OF THIS AGREEMENT BEFORE CLICKING THAT YOU AGREE.
CLICKING "I AGREE" INDICATES YOUR ACCEPTANCE OF THESE TERMS AND
CONDITIONS. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS
AGREEMENT, PROMPTLY CLOSE THIS PAGE AND DO NOT PROCEED WITH THE myPersonalDoc /
PHAGroup (Private Health Advisory
Service) SERVICE .
THE TERMS AND CONDITIONS CONTAINED
HEREIN GOVERN YOUR USE OF THE SERVICES PROVIDED BY PHAGroup/ myPersonalDoc
THROUGH THIS SITE (THE " PHAGroup/ myPersonalDoc "). HOWEVER, IF YOU
EXECUTE A WRITTEN AGREEMENT WITH PHAGroup/ myPersonalDoc, AND IF ANY OF THE
TERMS AND CONDITIONS OF THAT WRITTEN AGREEMENT ARE INCONSISTENT WITH THE TERMS
AND CONDITIONS HEREIN, THE TERMS AND CONDITIONS OF THE WRITTEN AGREEMENT WILL
PREVAIL.
In using the PHAGroup Service, you
may not: (1) distribute, rent, lease or sublicense all or any portion of the PHAGroup
Service; (2) modify or prepare derivative works of the PHAGroup Service; (3) publicly
display visual output of the PHAGroup Service; (4) transmit the PHAGroup
Service over a network, by telephone, or electronically using any means; or (5)
reverse engineer, decompile or disassemble the PHAGroup Service. You agree to
keep confidential and use your best efforts to prevent and protect the contents
of the PHAGroup Service from unauthorized disclosure or use.
1) I wish to use the PHAGroup/ myPersonalDoc Service to
facilitate the delivery of health care services from the providers who have agreed
to provide services through the PHAGroup/ myPersonalDoc Service (the
"Providers").
2) I understand that PHAGroup/ myPersonalDoc does not
provide health care services, and that PHAGroup/ myPersonalDoc simply provides
a system to facilitate communication between me and the Provider using PHAGroup/
myPersonalDoc 's software.
3) I understand that the PHAGroup/ myPersonalDoc Service is
not reimbursable by Medicare, Medicaid or any other government health care
program, and I will not use the PHAGroup/ myPersonalDoc Service for any
services that are or might be reimbursable by such programs.
4) I understand that the PHAGroup/ myPersonalDoc Service is
not reimbursable by any commercial insurer, managed care organization,
preferred provider organization or other payor, and I will not seek
reimbursement from any such payor for the cost of my use of the PHAGroup/ myPersonalDoc
D Service.
5) I understand that PHAGroup/ myPersonalDoc does not
credential Providers. I will hold PHAGroup/ myPersonalDoc harmless from any
liability for any claims that I might have relating to the qualifications of
the Providers.
6) I understand and agree that any claim arising out of my
use of the PHAGroup/ myPersonalDoc Service will be governed by NJ law, and that
any such claim will be resolved through binding arbitration conducted by the
American Arbitration Association, under its Consumer Procedures, in Somerset County,
NJ. If there is a dispute, PHAGroup/ myPersonalDoc and I will share equally in
the cost of the arbitration proceeding, and the prevailing party will be
entitled to recover its other costs, including attorney and expert fees, from
the other party.
7) If I am seeking services on behalf of a child, dependent
or other person for whose medical care I am responsible, my approval of the
terms of this Use Agreement will bind such other person to these terms.
I have read this Use Agreement and I understand it. I agree to
comply with it, on behalf of myself and on behalf of any other person on whose
behalf I am seeking medical care. I understand and agree that if I fail to
comply with the terms of the Use Agreement, I may be prohibited from using the PHAGroup/
myPersonalDoc program, and I will hold PHAGroup/ myPersonalDoc harmless from
any liability arising from my failure to comply.

PHAGroup/ myPersonalDoc
does not provide medical
advice, diagnosis or treatment. PHAGroup/ myPersonalDoc is a technology solution that allows you to interact with
healthcare providers. PHAGroup/ myPersonalDoc
is not the source of,
does not have any control over, does not monitor and takes no responsibility
for the content of communications, medical advice, diagnosis or treatment made
on or through PHAGroup/ myPersonalDoc. PHAGroup/ myPersonalDoc is not responsible for, and PHAGroup/ myPersonalDoc makes no representations or warranties with respect to, any
outcome that results from your use of PHAGroup/myPersonalDoc services.

PHAGroup/myPersonalDoc does
not recommend or endorse any specific tests, physicians, healthcare providers,
products, procedures, opinions, or other information that may be available.

PHAGroup/myPersonalDoc cannot
guarantee that it will always function without disruptions, delay or errors. In
the event of any emergency, call 911 immediately or your country’s or
city/town’s emergency number.
Eligibility to Register on the Site, Subscribe to the Services and
Use this Site and/or the Services.
You represent that you
are of legal age to agree to the terms and conditions set forth in these Terms
and Conditions, or you are at least 18 years of age and have your parent(s)' or
legal guardian(s)' permission to access and use this Site, to register on the
Site, to enroll for the Services and/or to use the Services . Some Services,
including, without limitation, access to the E-Consult, are not intended to be
used by, and are not directed to, anyone less than 18 years of age. If you
register for, enroll for, purchase and/or use the E-Consult service, you
represent you are at least 18 years of age. You represent that if you are
acting on behalf of an entity, you have the authority to bind such entity.
You are
solely responsible for maintaining the confidentiality of your password and for
all activities that occur under your password. You agree to prohibit anyone
else from using your password and to immediately notify PHAGroup/myPersonalDoc
in writing of any unauthorized use of your password or other security concerns
of which you become aware.
PHAGroup
may contact you by telephone, mail or email to verify your Personal Contact
Information. PHAGroup reserves the right to request further information from
you and you agree to provide such further information, to ensure you have not
fraudulently completed your registration on the Site or subscription to the Services.
If you do not provide this information to PHAGroup and in the manner requested
within fourteen (14) days of such request, PHAGroup may reject your
registration and subscription or suspend your registration and subscription
until you satisfactorily comply with PHAGroup 's information request.

security of your payment and purchase experience on the Site.

PHAGroup/myPersonalDoc
hereby grants you a limited, revocable, non-transferable and non-exclusive
license limited solely to viewing or downloading a single copy of the material
on the Site and to use the PHAGroup/myPersonalDoc software to the extent necessary to use the
Services solely for your personal, noncommercial use. With the exception of
your Electronic Medical Records, PHAGroup/myPersonalDoc retains all right,
title and interest in and to PHAGroup/myPersonalDoc, the Services and any
Information, products, documentation, software or other materials on the Site,
and any patent, copyright, trade secret, trademark, service mark or other
intellectual property or proprietary right in any of the foregoing, except for
Information on the Site licensed by PHAGroup/myPersonalDoc, and in that case,
the license provider retains all right, title and interest therein.
PHAGroup/myPersonalDoc
may, at any time and from time to time, in its sole discretion, change these
Terms and Conditions. Any changes to these Terms and Conditions will be
effective immediately upon posting of the changed Terms and Conditions on the
Site. You agree to review these Terms and Conditions periodically, and your use
of the Site following any such change constitutes your agreement to follow and
be bound by such changed Terms and Conditions.
Medical Disclaimers - PHAGroup/myPersonalDoc makes no representation or warranty as to
the content of any treatment response from any participating physician. You and
your physician are solely responsible for all information and/or communication
sent during a telephone medical consultation, secure email consultation or other
communication. PHAGroup/myPersonalDoc does not guarantee that a telephone
medical consultation or secure email consultation is the appropriate course of
treatment for your particular health care problem
You agree
to defend, indemnify and hold harmless PHAGroup and its Affiliates from and
against any and all rights, demands, losses, liabilities, damages, claims,
causes of action, actions and suits (no matter whether at law or equity), fees,
costs and attorneys' fees (including appellate level) of any kind whatsoever
arising, directly or indirectly, out of or in connection with (i) your use or
misuse or of the Site or the Services or any Information posted on the Site,
(ii) your subscription, (iii) your breach of the Terms and Conditions or the
Privacy Notice , (iv) your relationship with any participating physician , (v)
the content or subject matter of or any Information you provide to PHAGroup,
any of its Affiliates, any participating physician or Customer service agent,
and/or (vi) any negligent or wrongful action or omission by you in the use or
misuse of the Site or the Services or any Information posted on the Site,
including, without limitation, infringement of third party intellectual
property rights, privacy rights, or negligent or wrongful conduct.
YOU AGREE
TO WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ALL LAWS THAT MAY LIMIT THE
EFFICACY OF SUCH INDEMNIFICATIONS OR RELEASES. FOR EXAMPLE, YOU SPECIFICALLY
AGREE TO WAIVE THE PROVISIONS OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH
PROVIDES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR
DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE
RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT
WITH THE DEBTOR."
